Last Monday, the current president of the Republic of Peru, Dina Boluarte, decreed a state of emergency in the south of the country, specifically in the regions of Apurímac, Arequipa, and Ica, as a result of the wave of confrontations against the new government after Pedro Castillo's coup attempt.

The protests that spread throughout the country have already left eight people dead in just one week. Although the Government has already proposed the advancement of elections to the end of 2023, citizens continue to demand the release of the former president and the protests do not stop. For this reason, the Government of Peru has decided to declare a state of emergency for the entire country for at least 30 days. But what will it entail? What consequences will it have for citizens?

Suspension of assembly and transit rights

"The state of emergency has been agreed for the entire country, due to the vandalism and violent acts, the seizure of highways and roads that are already stabilizing acts and require a forceful and authoritative response," he said. Defense Minister Alberto Otarola.

Article 137 of the Constitution of the Republic of Peru includes the regulations applied to states of exception, emergency, and siege. The law determines that the Presidency of the Republic, with the agreement of the Council of Ministers, can decree for a specific period of time in the entire national territory or in part of it, the state of emergency.

A state of emergency is declared "in case of disturbance of the peace or internal order, catastrophe or serious circumstances that affect the life of the Nation." Likewise, during the time that it is decreed, "the exercise of constitutional rights related to personal liberty and security, the inviolability of the home and freedom of assembly and transit may be restricted or suspended."

Such a way that this declaration will imply the suspension of assembly rights, inviolability of the home, and freedom of transit, while the possibility of implementing the curfew is studied. The declaration of this state cannot exceed 60 days and its extension "requires a new decree." During the time it lasts, "the Armed Forces assume control of the internal order if so ordered by the President of the Republic," the regulations state.
